Architectural enforcement is in the interest of and responsibility conveyed by the deed restrictions of keeping the neighborhood looking nice, retaining property values, etc.

There are a lot of houses with siding that is in need of attention, and the homeowner may want to inspect the zero lot side for damage. There is usually damage up to two feet from the bottom where rain splashes from the neighbor's deck onto the wood siding.

When homeowners request ACC approval, here are a few tips:

  1. Send in your platt, and actual color changes, not just color numbers or it will be rejected.
  2. The architecture must fit the current house architecture.
  3. The changes should not affect the neighbors structure, ie the damage to the siding above, indicating improper drainage or other issues.

(3) Use of Easement.

(v) Neither the Side Yard Wall Lot owner or the adjacent Lot owner shall attach any object to the Side Yard Wall. The adjacent Lot owner shall not use the Side Yard Wall as a playing surface for any sport. No structure shall be constructed or placed upon the Side Yard Land Maintenance Easement by either the Side Yard Wall Lot owner or the adjacent Lot owner, except that the adjacent Lot owner may construct a fence which allows drainage.

General Deck guidelines:

      1. Permanent aspect of deck cannot encroach upon Side Yard Wall (Zero Lot Line) ground area.
      2. Permanent aspect of overhang cannot encroach upon Side Yard Wall (Zero Lot Line) ground area.
      3. Use of treated lumber up to Side Yard Wall area easement demarcation line.
      4. Retractable awning up to 1 foot from Side Yard Wall trim/eaves, i.e. a temporary awning.
      5. Removable deck extension up to 1 foot from Side Yard Wall foundation, of treated decking material, i.e. a temporary, moveable deck. The removable portion of the deck must be easily lifted by a single, average adult.

    Section 9. Wires and Lines. No lines, wires or devices for the communication or transmission of electric current, cable television or telephone shall be erected, placed or maintained upon any Lot unless the same shall be contained in conduit or cable installed and maintained underground or concealed in, under or on buildings; provided, however, that this section shall not forbid the erection or use of temporary power or telephone lines incidental to the construction of buildings upon a Lot or utility company feeder lines into the Subdivision.

  3. Other guidelines:
    1. Plants trimmed at least one foot away from Side Yard Wall eaves.
    2. Plants trimmed six inches away from Side Yard Wall siding.
    3. Maximum size of storage shed is 5' x 6', precluding frontal elevation visibility.
    4. Fences must be 6' privacy fencing of either concrete or wood.
    5. Changes to house color and trim must be approved.
    6. Garage conversions must use matching stone on the frontal elevation, wood trim and siding will not be approved.
    7. One year to bring an overhang or deck into compliance.
      1. Decks can be reduced to the Deed-stipulated distance from the Side Yard Wall, and the remaining portion can be up to a foot away. The remaining portion cannot be anchored to the ground at any time.
      2. Overhangs may be a retractable awning which cannot be closer than 1 foot from the Side Yard Wall eave or trim.
      3. Letters will be sent every three months, and then other action will be considered if the changes are not completed, unless prior communication is made with either the Board of Directors or the Architectural Control Committee.
    1. No other permanent structures to be placed on the Side Yard Wall easement, except fencing.
